Terms of Service
Last updated on 28 October 2026.
1. General
Kelid is a service offered by Macocian Software, whose registered office is at Place Terdelt 5, 1030 Schaerbeek, Belgium, registered with the Crossroads Bank for Enterprises (CBE) under number 1043.980.217, VAT number: application pending.
These Terms of Service (the “Terms”) govern the use of Kelid, the website at kelid.eu and the application at app.kelid.eu (together, the “Website”), including the application installed on a phone from it. Any registration with Kelid under the conditions described below constitutes express and unreserved acceptance of the Terms, which prevail over any other document.
Macocian Software may update and modify the Terms at any time. In the event of a significant change, the Client will be informed by email fifteen (15) days before the change takes effect. New features added to Kelid, including additional services offered by Macocian Software and accepted by the Client, are subject to the Terms. Continuing to use Kelid after a change has taken effect constitutes acceptance of it.
The Terms cancel and replace any prior proposal or agreement relating to the same subject matter. They may only be departed from with the express written agreement of Macocian Software. A failure by Macocian Software to rely on the Terms can never be interpreted as a waiver of the right to rely on them later.
The Terms apply to every subscription (the “Subscription”) concluded between Macocian Software and its customers and users (the “Client”), including those already in progress once the Terms have been communicated to the Client and the Client has not contested them. The Privacy Policy forms part of the Terms.
2. The service
Kelid is a paid service, accessible only online through the Website, which lets property owners and managers handle the administrative and financial tasks relating to their real estate.
Kelid in no way replaces the Client’s own management. Any advice given by Macocian Software concerns only the use of the software, never the organisation or management of the Client’s affairs.
The software offered is standard software. By using it, the Client acknowledges that Kelid may not meet the specific needs of their management.
3. Creating an account
To create an Kelid account, every user declares, under their sole responsibility, that they:
- are at least 18 years old;
- provide their full name, a valid email address and any other information required to complete registration, and confirm that address by following the link mailed to it;
- are responsible for keeping their login details secure and confidential. Macocian Software cannot be held liable for any damage or loss resulting from the Client’s failure to protect them.
4. Free trial and duration
Every new account starts with a free trial of thirty (30) days, which begins when the first user confirms their email address. No payment details are asked for during the trial, and it does not turn into a paid Subscription by itself: when it ends, the account is locked until the Client subscribes. Nothing in it is deleted when it is locked; article 7 says how long a locked account is kept.
The Client may subscribe at any time, during the trial or after it, for one month or one year. The Subscription takes effect on the day it is paid for, and at the end of each period it is renewed automatically for the same duration.
The Client may cancel the renewal at any time before it takes place, from the settings page of the application. Cancelling ends nothing straight away: the account stays usable until the end of the period already paid for, and is then locked like an account whose trial has ended.
Macocian Software may stop offering Kelid at any time. In that case, the Client will be notified by email and will either keep access until the end of the period already paid for, or be given at least one (1) month’s notice before access ends permanently. During this notice period, the Client must take every measure needed to save their data. Ceasing to offer Kelid cannot give rise to any compensation from Macocian Software to the Client.
Macocian Software may change the software at any time to make the improvements and changes it considers useful or necessary. The Client may not claim any compensation for such changes.
5. Payment, prices and invoicing
Payment is taken through Stripe at the start of each period, monthly or yearly depending on the Subscription, and an invoice is issued for each. The Client agrees to receive invoices in electronic form only. Each invoice is due on the day it is issued.
The price of a Subscription is the one shown on the Website when the Client subscribes. Macocian Software may change its prices; the Client will be told by email at least thirty (30) days before a new price applies to their Subscription, and it applies from the first renewal after that date. A Client who does not accept the new price may cancel the renewal as described in article 4.
No refund or credit is given for a period that has been paid for and is partly used or unused, including when the Client cancels or closes their account during it.
6. Closing the account
The Client may close their account at any time from the settings page of the application, confirming with their password. Closing cancels any running Subscription and permanently deletes the account and everything stored in it, for every user sharing it; it cannot be undone. The Client may download a copy of their data beforehand. Invoices already issued are kept, as the law requires.
A user of an account shared with others may leave it in the same way, which deletes only that user. The last user of an account closes it instead.
7. Suspension and deletion of the account
Macocian Software may, (i) if the Client fails to pay any of their invoices, or (ii) if the Client breaches any clause of the Terms, suspend the Client’s access to Kelid immediately after notifying the Client, until full payment of the sums due or until the Terms are complied with.
If a breach of the Terms is not remedied within fifteen (15) days of a formal notice sent by email setting it out, the account may be permanently deleted, without any refund and without prejudice to Macocian Software’s right to claim damages for the harm suffered. The Client may not claim any compensation following a suspension or deletion under this article.
An account that has been locked for one (1) year, because its trial ended or its Subscription lapsed, is permanently deleted along with everything stored in it. Its users are warned by email beforehand, and subscribing before that date keeps it. An account whose email address was never confirmed is deleted thirty (30) days after it was created.
8. The Client’s data
The data the Client stores in Kelid (properties, tenants, leases, financial information, documents and so on) is and remains the property of the Client. Macocian Software processes it only to provide the service, as described in the Privacy Policy, which also says how the personal data in it is protected.
The Client is solely responsible for the data they store in Kelid. They warrant that it belongs to them or that they have the right to use it and entrust it to Macocian Software, that it is lawful and accurate, and that they have fulfilled every obligation incumbent on them towards the people it concerns, their tenants in particular.
The Client indemnifies Macocian Software against any claim by a third party, on any ground, relating to the Client’s use of Kelid or to the data they stored in it. If Macocian Software calls on the Client following such a claim, all of Macocian Software’s legal costs, lawyers’ fees included, will be borne by the Client.
9. Force majeure
Macocian Software is released from its obligations under the Terms to the extent that their performance is prevented by force majeure: an unforeseeable, unavoidable event beyond its control, such as a failure of its hosting provider.
If the event cannot be remedied within thirty (30) days of its occurrence, Macocian Software may terminate the Subscription without owing the Client any compensation, keeping the sums due at the date of termination.
The party prevented from performing by force majeure must keep the other regularly informed of the prospects of remedying it, and the obligations arising from the Terms are suspended for as long as it lasts.
10. Intellectual property
The trade name Kelid and every Kelid logo are the exclusive property of Macocian Software, as is any visual content of Kelid (a copy or screenshot) accessible on the Website or connected with Kelid.
All elements making up the Website, whether or not accessible to the Client, are the exclusive property of Macocian Software, in particular the software, its databases, the pages of the Website (content, text, images, graphics, icons, videos), the management tools, the platform, and any other tool or information made available to the Client.
Except with the express, prior written authorisation of Macocian Software, the Client, their agents and anyone else to whom the Client gives access to Kelid are strictly prohibited from:
- copying, reproducing, modifying, representing, publishing, adapting, transmitting or translating, in any form and by any means, all or part of the Kelid software, or of the information or services provided by Macocian Software;
- using the software in any way or for any purpose other than those described on the Website or in the Terms;
- assigning, for payment or free of charge, all or part of the rights and obligations they hold under their Subscription.
The Subscription grants the Client a licence to use the software for its duration, to the exclusion of any other right.
Unless the Client expressly objects, Macocian Software may name its clients for promotional purposes, on any medium including the Website, together with their logos and extracts of their comments.
11. Obligations and liability
Macocian Software undertakes to do everything possible to provide a quality service. Despite the care it takes to keep the service running continuously, interruptions are possible, without liability on its part, in the event of a breakdown or failure of its hosting provider, or where maintenance is necessary or useful.
Technical support is given by email or by remote assistance, every working day from 8:30 to 17:30 (Brussels time), through the form on the Website or at [email protected].
Macocian Software cannot be held liable for the loss of the Client’s data, even in the event of a failure of the software or of its servers. The Client is aware that they must at all times keep an up-to-date copy of the data they store in Kelid.
Macocian Software cannot be held liable for theft of information, whether physical (theft of documents) or electronic (viruses, spyware, hacking and so on), nor for its consequences for the Client, if it occurs despite the precautions taken. The Client acknowledges this risk and remains free not to entrust Macocian Software with information they consider too sensitive.
Wherever the liability of Macocian Software is invoked and established, only its gross negligence, its wilful misconduct, or its breach of an essential obligation may be held against it. In that case, by express agreement, the total compensation it owes may not exceed the amount invoiced for the period during which the damage occurred. Macocian Software can never be held liable for indirect losses that do not result directly and exclusively from a failure of its service, such as commercial loss, loss of contracts or profits, or damage to reputation.
Any claim against Macocian Software must, on pain of forfeiture, be made by email within seventy-two (72) hours of the event giving rise to it.
The Client is aware of the characteristics and limits of the internet, a worldwide interconnection of networks that nobody, Macocian Software included, controls, and accepts in particular that:
- data travelling over the internet does so over networks of varying characteristics and capacity, with only relative technical reliability, so that nobody can guarantee the internet works properly;
- data travelling over the internet may be intercepted, so that passwords, codes and, more generally, any sensitive information are sent at the Client’s own risk;
- it is up to the Client to take every appropriate measure to protect their own devices, data and software from viruses and from intrusion by third parties;
- Kelid may not be used to transmit viruses or any other malicious content;
- Kelid may not be used to store, host or send unsolicited messages (spam), by email or otherwise.
Accordingly, the Client waives the right to hold Macocian Software liable for any of the facts or events listed above.
The Client is solely responsible for any direct or indirect, material or immaterial damage caused by them or their agents to Macocian Software through their use of Kelid, and undertakes to indemnify Macocian Software for it, including any damages, court costs and lawyers’ fees it is ordered to pay, and to reimburse every cost incurred in repairing it.
12. Severability
If one or more provisions of the Terms are invalid, void or unenforceable, the validity of the other provisions is in no way affected. Macocian Software and the Client will then consult each other to replace them with a provision as close as possible to the purpose of the original.
13. Governing law and disputes
The Terms are governed by Belgian law. They are published in several languages; the French version alone is authoritative, and the others are translations for information. In the event of a discrepancy, the French text prevails.
Failing an amicable agreement, any dispute relating to the performance or interpretation of the Terms or of a Subscription falls under the exclusive jurisdiction of the courts of the judicial district of Brussels (Belgium).
