Ending a lease in Belgium, in short
Each region has its own rules. Choose yours.
When does the notice period start?
A notice that may be given at any time runs from the first day of the following month: given on 15 October, a three-month notice runs from 1 November to 31 January. A notice for a fixed date, such as the end of a three-year period, only has to reach the other party the required number of months before that date. Since November 2024, that notice counts from the day the other party is presumed to know of it: for a registered letter, the day it is presented at their address.
What does a tenant owe for leaving a nine-year lease early?
Three months’ notice, at any time. If the lease ends in its first, second or third year, the tenant also owes three, two or one month’s rent. From the fourth year on, nothing more.
And for leaving a short lease early?
Three months’ notice and one month’s rent, whatever the year. A lease of under six months cannot be ended early.
When can the landlord end a nine-year lease?
- To live there, or house a relative: at any time, with six months’ notice and no indemnity. For a brother, sister, nephew, niece, uncle or aunt, the lease cannot end before its first three years are over. The occupant must move in within a year and live there for at least two years, or the landlord owes the tenant 18 months’ rent.
- For major works: only to end the lease at the end of its first or second three-year period, with six months’ notice. The works must cost more than three years’ rent, start within six months and be finished within two years, or the landlord owes the tenant 18 months’ rent.
- Without a reason: only at the end of the first or second three-year period, with six months’ notice, paying the tenant nine or six months’ rent.
Once notified, the tenant may leave earlier with one month’s notice and no indemnity.
Can the landlord end a short lease early?
Only after the first year, to live there or house a close relative, with three months’ notice and one month’s rent as indemnity. The tenant may then leave earlier with one month’s notice.
What happens at the end of the lease?
To end a nine-year lease at its term, both parties give six months’ notice. Without one, it is renewed for three years at a time. A short lease ends with three months’ notice from either side. Without one, or if the tenant stays on, it becomes a nine-year lease counted from its start. A lease of under six months simply ends at its term.
How is notice given?
The law prescribes no form, but whoever gives notice must be able to prove it, so send a registered letter. Notices to married or legally cohabiting tenants go to each of them separately, and one of them cannot end the lease of the family home without the other’s consent.
The German-speaking Community applies the same Walloon decree.

This calculator covers main residence leases and is for information only, not legal advice; the lease and the regional rules decide. Student leases, flat shares, leases over nine years and lifelong leases follow other rules.
